(May 17, 2021, 9:24 p.m. EDT) – The Tenth Circuit has “abdicated its judicial duty” by killing most constitutional claims in a lawsuit accusing Santa Fe of exposing residents to dangerous levels of radiation by installing telecommunications equipment in public rights-of-way, an environmental group told the court.
The Santa Fe Alliance for Public Health and Safety wants the full circuit court to review the ruling, which partially revived the environmental group’s lawsuit, but failed to result in an all-out victory for the organization, judging the missing allegations but converting the dismissal with prejudice one without.
